TERMS OF SALE

GENERAL TERMS AND CONDITIONS OF SALE FOR THE WEBSITE WWW.GATTULLO.IT
Contracts concluded via the website www.gattullo.it fall under the category of distance sales contracts between Gattullo S.r.l. (hereinafter also referred to as the “Company”)—with its registered office at P.le di Porta Lodovica 2, 20136 Milan, Italy (registered in the Register of Companies; Tax Code and VAT No. 05887150158)—and the Consumer; the subject matter of these contracts is the sale and purchase of products selected electronically on the website www.gattullo.it. Such sales are governed by these Conditions, which are to be considered an integral and essential part of the sales contract. Customers are therefore advised to read the conditions of sale carefully before submitting an order. The Company reserves the right to update these conditions of sale at any time, including to reflect regulatory adjustments or changes; such modifications shall take effect from the date of their publication on the website www.gattullo.it. Submission of the electronic order—completed by the Customer in the designated section of the website—constitutes acceptance of the conditions of sale in force at that time and signifies consent to the purchase, thereby finalizing the sales contract.

A. PURCHASE ORDERS MANAGEMENT
Purchase orders are managed according to the following phases: 1) Sending of the order filled in the appropriate section of the site by the Customer.
2) Acceptance of the order by Gattullo S.r.l., transmitted to the Customer via email, containing key information: the quantity of the product ordered, its price, payment methods, the shipping method and associated cost, the shipping address, and billing details.
The acceptance and fulfillment of the order will take place only after the payment has been credited.
In the event that the quantity of the products ordered exceeds the Company’s availability, the Customer will be promptly informed by email, so as to choose whether to replace the missing product, modify or cancel the order without any expense and the Company will refund the Customer any sum not due that may have already been paid.
The Customer releases the Company from any liability arising from any incorrect completion of the order form, even in relation to the delivery address alone and/or the issuing of incorrect tax documents, the Customer being the only person responsible for the correct entry of data in the order form. Minors under 18 years of age are not authorized to transmit orders via the online order form.

B. SALES PRICES AND INVOICING
The prices of the products displayed on the site are expressed in € (Euro) including VAT and any other tax, containers and packaging. Shipping costs are not included. Any promotions relating to the sales price and/or shipping costs are valid only during the period of publication on the site. Payment of the price can only be made in € (Euro) currency and the amounts will be shown on the invoice only in € (Euro). The invoice will be sent to the Customer at the email address indicated in the order phase.
The possibility of entering a VAT number is foreseen.

C. SPECIAL OFFERS, DISCOUNT COUPONS AND FREE SHIPPING
The conditions relating to special offers, promotions and discount coupons will be indicated from time to time on the website www.gattullo.it through ad hoc communications.

D. PAYMENT METHODS
Payment can be made by Credit Card and Bank Transfer in advance.
1) CREDIT CARD
Purchases using a Credit Card are managed through the BNL Axepta pHey circuit.
The accepted credit cards are: Visa, Mastercard, Maestro, VPay, AMEX
Shipping will be carried out only after notification of receipt of payment by the bank.
2) BANK TRANSFER
When purchasing via advance bank transfer, it is advisable—in order to expedite shipping—to email a copy of the transfer receipt to the Company at info@gattullo.it. The order will be accepted and processed only after the payment has actually been credited; this must occur no later than 10 (ten) business days after the order is placed. After this deadline, the order will no longer be valid and will be cancelled. The payment reference (causale) must include the full name or company name of the person who placed the order, as well as the order number and date.

E. SHIPPING
Purchased items will be shipped on the business day following receipt of the order; in the case of payment via advance bank transfer, shipment will occur on the business day following the crediting of the payment. Products will be delivered to the shipping address provided by the Customer during the order process. Depending on the destination, delivery may take between 2 and 10 days, barring unforeseen circumstances. For information regarding large shipments (exceeding 100 kg) or destinations not included in the list of foreign countries, please contact the Company directly at info@gattullo.it to request a personalized quote.
To ensure timely delivery, we recommend providing an address where someone is certain to be present to receive the package, as well as a telephone number for easy contact.
The user acknowledges that taking delivery of the Product is a specific obligation arising from the purchase contract. In the event of non-delivery due to the recipient’s absence at the address specified in the order form, the courier will leave a notice confirming the delivery attempt (a “missed delivery” notice). This notice will include a telephone number that the user can call to request a subsequent delivery attempt.
The user may provide a shipping address that differs from the billing address and specify whether the order is a gift.
Gattullo S.r.l. reserves the right to use other carriers and/or alternative delivery methods. In such cases, the change will be specified during the purchasing process.
SHIPPING COSTS
Shipping costs vary based on the destination country and the quantity of product purchased. They are calculated automatically and when placing the order you can check the exact amount directly in the virtual cart.
ITALY
Shipping costs for Italy start from €25 and vary based on the weight that will be calculated at the time of purchase.
Only for Italy, for orders over 200 € shipping costs will be free.
FOREIGN COUNTRIES
Transport costs to foreign countries vary based on the destination and weight of the product, and range from a minimum of €25 for 5 kg to a maximum of €130 for 100 kg.
The costs will be calculated automatically and you can check the exact amount directly in the virtual cart.
List of foreign countries: Austria, Germany, Spain, France, Monaco, Belgium, Holland, Luxembourg, Great Britain, Portugal, Ireland, Greece, Denmark, Sweden, Finland, Lithuania, Latvia, Estonia, Slovenia, Czech Republic, Slovakia, Hungary, Poland, Romania, Bulgaria, Switzerland.
For delivery to countries not included in the list, the Customer is requested to contact the company at info@gattullo.it to find out about feasibility, costs, times and shipping methods.
The goods must be checked upon delivery and any damage must be reported to the courier.

F. RETURNS AND RIGHT OF WITHDRAWAL (pursuant to Legislative Decree no. 206 of 6 September 2005)
Should the Customer not be satisfied with the purchased products, they may exercise their right of withdrawal by sending a notice via registered mail with return receipt to Gattullo S.r.l., with its registered office at P.le di Porta Lodovica 2, 20136 Milan, Italy, within 14 days of receiving the purchased products. Customers are encouraged to send an advance copy of this notice to the email address info@gattullo.it, including the purchase order details. The purchased products must be returned to our premises within 14 days of receipt; subject to verification of the goods, the Company will refund the amounts paid. on the same means with which the payment was made as soon as possible, in any case no later than 30 days from receipt of the notice of withdrawal. The returned products must reach the Company’s headquarters intact, inserted in their original packaging complete in all its parts, as received by the Customer. The return of the purchased products is the responsibility and expense of the Customer in accordance with art. 67, paragraphs 3 and 4 of Legislative Decree no. 206 of 06/09/2005.

G. APPLICABLE LAW
These Conditions of Sale and the sales contracts concluded via the website www.gattullo.it are governed by Italian law, in accordance with relevant EEC directives (Legislative Decree no. 206 of 6 September 2005 – Consumer Code; Legislative Decree no. 70 of 9 April 2003; and subsequent amendments and additions). The Customer releases Gattullo S.r.l. from any liability regarding malfunctions, service interruptions, or performance degradation—whether or not caused by *force majeure* or unforeseeable circumstances—unless directly attributable to the Company due to willful misconduct or gross negligence. The Court of Milan shall have exclusive jurisdiction over any dispute concerning the interpretation of these Conditions of Sale or the commercial relationships arising therefrom between the Company and the Customer.
